Terms of Service

By accessing or using 4u4.us (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. These Terms apply to all visitors, users, and others who access or use the Service.

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or a prominent notice on the website. Your continued use of the Service after such notification constitutes acceptance of the updated Terms.

4u4.us is an AI-powered project management platform that provides interconnected tools including AI MindMaps, Active Kanban boards, Auto-Gantt charts, and an AI assistant. The Service is offered under a freemium model with optional paid subscription tiers.

To access certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your password secure and not share it with third parties
• Notify us immediately of any unauthorized use of your account at legal@4u4.us
• Accept responsibility for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent, illegal, or harmful behavior.

4u4.us offers Free, Developer (BYOK), and Pro subscription plans. Paid subscriptions are billed in advance on a monthly or annual basis. All payments are processed securely via Stripe.

Free Trial. Eligible paid plans include a 14-day free trial. No charges are made during the trial period. Cancellation before the trial ends incurs no fees.

Cancellation. You may cancel your subscription at any time through your billing portal. Access remains active until the end of the current billing period. We do not provide refunds for partial periods, except where required by law.

Price Changes. We reserve the right to modify pricing with 30 days' advance notice. Continued use of the Service after the price change takes effect constitutes acceptance of the new pricing.

The Developer plan and certain features allow you to connect your own third-party AI API keys (e.g. Google Gemini, Groq, Anthropic). By using BYOK features, you acknowledge that:

• You are solely responsible for obtaining and managing your API keys in compliance with the terms of the respective AI providers
• Your API keys are stored exclusively in your browser's localStorage and are never transmitted to or stored on 4u4.us servers
• Usage costs charged by the AI provider are your sole responsibility
• 4u4.us makes no warranties regarding the availability, accuracy, or fitness of third-party AI outputs

You agree not to use the Service to:

• Violate any applicable local, national, or international law or regulation
• Transmit any unsolicited or unauthorized advertising or promotional material (spam)
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity
• Engage in any data mining, scraping, or other unauthorized automated data collection
• Attempt to gain unauthorized access to any portion of the Service or its related systems
• Introduce viruses, trojans, worms, or other malicious code
• Interfere with or disrupt the integrity or performance of the Service
• Generate, store, or process illegal content of any kind

Our Property. The Service and its original content (excluding user-provided content), features, and functionality are and will remain the exclusive property of 4u4.us and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of 4u4.us.

Your Content. You retain ownership of any content you create, upload, or store using the Service ("User Content"). By using the Service, you grant us a limited, non-exclusive, royalty-free license to host, store, and display your User Content solely as necessary to provide and operate the Service.

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to our collection and use of data as described in the Privacy Policy.

As described in our Privacy Policy, we do not store the contents of your project nodes on our servers. Your project data resides either in your connected GitHub repository or on your local device.

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

4u4.us does not warrant that: (a) the Service will function uninterrupted, secure, or available at any particular time or location; (b) any errors or defects will be corrected; (c) the results of using the Service will meet your requirements.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL 4u4.US, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of (or inability to access or use) the Service
• Any conduct or content of any third party on the Service
• Unauthorized access, use, or alteration of your transmissions or content

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

You agree to defend, indemnify, and hold harmless 4u4.us and its affiliates, officers, agents, and employees from any claim, liability, damage, loss, and expense, including reasonable attorneys' fees, arising out of or in any way connected with your use of the Service, your User Content, or your violation of these Terms.

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease.

You may terminate your account at any time by contacting us at legal@4u4.us or through your account settings.

These Terms shall be governed by and construed in accordance with applicable law, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration or in the competent courts of jurisdiction, as appropriate.
